Defending You Against Misdemeanor Charges

In New York, offenses are classified into three categories: traffic infractions and violations, misdemeanors and felonies.  Traffic infractions and violations are non-criminal offenses, meaning that do not create a criminal record if you are convicted of these low level offenses. These offenses include disorderly conduct, most local ordinances, speeding and other moving violations. Misdemeanors include offenses where the punishment can be up to one year in a local county or city jail. If you are convicted of a misdemeanor, you will have a criminal record for the rest of your life because New York, unlike some states, does not have an expungement statute. Misdemeanors are subdivided into three different categories (Class A, Class B, and unclassified), and they include offenses like assault without a weapon, basic possession of illegal drugs for personal use, driving while intoxicated, and larceny (if the value of the property is under $1000).  Our office strives to resolve a first time misdemeanor charge with a non-criminal disposition so that our clients avoid creating a criminal record, which can follow that person for the rest of his or her life.  The statute of limitations for misdemeanors is two years and the maximum term of probation is three years or six years in sex offender cases.
